1. Background
These Terms & Conditions (“Terms”) govern the use of Customa’s services (“Services”), including the scanning of stomas via supported applications (such as Scaniverse), the creation of personalised stoma cutting templates (PDF), physical 3D printed stoma replicas, and virtual stoma replicas. These Terms form a legally binding agreement between Customa Pty Ltd (ABN: 11 601 689 712) (“Customa”, “we”, “us”, “our”) and you (“Customer”, “you”).
By engaging with our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not accept these Terms, you must not use the Services.
2. Services Provided
Customa provides tools to support individuals with stoma care. Using your personal smartphone scan, we generate an accurate replica of your stoma and create a customised cutting template for your baseplates and one-piece systems. Depending on your order, you may also receive a physical 3D printed replica and/or a virtual 3D file for personal use.
The Services are intended to enhance comfort, security, and confidence in stoma care. However, our Services are not a substitute for professional medical advice, diagnosis, or treatment. You should always consult your healthcare professional before making medical decisions.
3. User Responsibilities
– You are responsible for providing accurate and clear scans of your stoma using supported scanning tools.
– You must ensure your information and shipping details are correct.
– You must not misuse the Services, resell our products, or attempt to reverse engineer our templates or replicas.
– You acknowledge that our Services are designed for personal use only.
4. Payment and Termination
Payment for Services must be made in accordance with the pricing set out on our Website or order form. Customa reserves the right to suspend or terminate Services if payment is not received or if you breach these Terms.
Either party may terminate the agreement upon written notice. Upon termination, you must cease use of any Services provided.
5. Liability and Disclaimers
Customa provides its Services on an ‘as is’ basis. While we take care to ensure accuracy and quality, we do not guarantee that templates or replicas will be error-free. We are not responsible for any indirect, incidental, or consequential damages, including but not limited to discomfort, leakage, or improper product fit.
Nothing in these Terms excludes any rights you may have under the Australian Consumer Law.
6. Data and Privacy
By using our Services, you agree to provide Customa with stoma scan files and related personal information. This information is used solely for the purpose of generating your personalised templates and replicas. Your data will be handled in accordance with our Privacy Policy, which can be found on our Website.
7. Intellectual Property
Customa retains all intellectual property rights in the methods, designs, templates, 3D models, and branding developed as part of the Services. You are granted a limited, non-transferable licence to use the products created for your personal stoma care. You must not reproduce, distribute, or exploit our intellectual property without permission.
8. Consumer Rights
Our Services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement, repair, or refund in the event of a major failure, and to compensation for any other reasonably foreseeable loss or damage. For minor issues, you are entitled to a remedy within a reasonable time.
9. Governing Law
These Terms are governed by the laws of Western Australia. You agree to submit to the jurisdiction of the courts of Western Australia.
10. Dispute Resolution
If you have a dispute with Customa, you agree to first attempt to resolve it with us directly for at least 30 days before commencing legal proceedings. Any disputes not resolved may be referred to arbitration in accordance with the laws of Western Australia.
